WIGGLE TERMS OF SERVICE

These Terms of Service (“Terms”) govern your purchase of, access to and use of the Wiggle mobile application, website, memberships, programmes, workouts, live and recorded classes, educational materials, coaching features and related services (collectively, the “Service” or “Wiggle”).

Wiggle is operated by AADAMRICHARDSON LTD, a company registered in Scotland under company number SC835364, with its registered office at Clyde Offices (2nd Floor), 48 West George Street, Glasgow, Scotland, G2 1BP (“Wiggle”, “we”, “us” or “our”).

By creating an account, purchasing a membership or using the Service, you agree to these Terms.

Please read them carefully before purchasing or using Wiggle.

Nothing in these Terms affects your statutory rights as a consumer.


1. ABOUT WIGGLE

Wiggle is a digital fitness, exercise, strength, movement and mobility platform designed to help users move more, improve their fitness and develop their strength and mobility.

Depending on your membership tier and the features available at the time, Wiggle may include:

  • personalised or recommended exercise programmes;

  • strength and mobility programmes;

  • live exercise and mobility classes;

  • recorded and catch-up classes;

  • on-demand follow-along workouts;

  • short daily movement and mobility sessions;

  • fitness and movement education;

  • workout, activity and progress tracking;

  • step tracking and leaderboards;

  • challenges and streaks;

  • coaching features;

  • community features;

  • fitness assessments;

  • exercise technique feedback;

  • one-to-one coaching; and

  • other fitness, movement, education and wellbeing features.

The specific features included in each membership tier will be displayed before purchase.


2. ELIGIBILITY AND YOUR ACCOUNT

You must be at least 18 years old to purchase a Wiggle membership unless we expressly state otherwise.

When creating an account, you agree to provide accurate and current information.

Your account and membership are personal to you. You must not share, transfer, resell or otherwise allow another person to use your paid membership unless we expressly permit this.

You are responsible for keeping your login details secure.

3. MEMBERSHIP OPTIONS

Wiggle may offer different membership tiers and services, including:

  • Wiggle memberships;

  • Bendy Buttery Club memberships;

  • one-to-one coaching memberships; and

  • other memberships, programmes or services introduced from time to time.

Memberships may be available on a monthly or annual basis depending on the particular product or membership tier.

The price, billing frequency, minimum commitment (if any), included features and other important information will be clearly displayed before you purchase or upgrade.

By purchasing a recurring membership, you authorise us and/or our payment provider to charge your selected payment method in accordance with the billing frequency shown to you at checkout until your membership is cancelled or auto-renewal is switched off.


4. MONTHLY MEMBERSHIPS

Monthly memberships operate on a rolling monthly basis.

Unless you cancel your membership or switch off auto-renewal, your membership will automatically renew each month and your selected payment method will be charged the applicable monthly membership fee.

There is no minimum notice period required to cancel.

You can cancel at any time.

If you cancel or switch off auto-renewal, you will continue to have access to the membership until the end of the billing period you have already paid for, unless your access ends earlier because you have exercised a refund or other cancellation right.

You will not be charged for another monthly billing period following effective cancellation.

Ordinary monthly renewals do not create a new 14-day Wiggle money-back guarantee.


5. ANNUAL MEMBERSHIPS

Annual memberships are paid in advance for a 12-month membership period.

Unless you cancel your membership or switch off auto-renewal, your annual membership will automatically renew at the end of the applicable membership period and your selected payment method will be charged the applicable annual membership fee.

There is no minimum notice period required to cancel.

You may switch off your annual auto-renewal at any time before renewal.

If you do so, you will continue to have access to Wiggle until the end of the annual membership period you have already paid for.

Cancelling or switching off auto-renewal does not ordinarily entitle you to a pro-rata refund of the current membership period, except where you are exercising our 14-day money-back guarantee, an applicable renewal cooling-off right or another right provided by law.


6. 14-DAY MONEY-BACK GUARANTEE – NEW MEMBERSHIPS

We offer a 14-day money-back guarantee on the initial purchase of both monthly and annual Wiggle memberships.

This is intended to give you an opportunity to try Wiggle and decide whether the membership is right for you.

If you purchase a new monthly or annual membership and decide that you do not wish to continue, you may request cancellation and a refund within 14 days of your initial purchase.

Where our 14-day money-back guarantee applies, we will refund the membership payment to the original payment method.

Monthly memberships

The 14-day Wiggle money-back guarantee applies to your initial purchase only.

It does not restart every month and does not apply to ordinary monthly renewal payments.

You may still cancel a monthly membership at any time to prevent future payments.

Annual memberships

The 14-day Wiggle money-back guarantee applies to your initial annual purchase.

Annual memberships may also qualify for a separate 14-day renewal cooling-off period as explained below.

Our contractual money-back guarantee is additional to and does not remove or restrict any statutory rights you may have under UK consumer law.


7. ANNUAL RENEWAL COOLING-OFF PERIOD

Following the automatic renewal of an annual membership, you will have a 14-day renewal cooling-off period.

During this period, you may cancel the renewed annual membership.

Any refund due following the exercise of a renewal cooling-off right will be handled in accordance with applicable consumer law.

Where applicable law requires us to provide you with a cooling-off notice following renewal, we will do so.

This renewal cooling-off period applies to qualifying annual renewals and does not mean that a new 14-day refund period arises following each ordinary monthly renewal.

Nothing in this section limits any greater cancellation or refund rights you may have under applicable law.


8. ANNUAL RENEWAL REMINDERS

We want annual renewals to be transparent and easy to manage.

For annual memberships, we intend to notify you approximately:

  • 30 days before your annual renewal date; and

  • 7 days before your annual renewal date.

The reminder will make clear that your membership is approaching renewal and will provide relevant information about your renewal, including the applicable price and how you can cancel or switch off auto-renewal.

You are responsible for keeping the email address associated with your account accurate and up to date.

Renewal reminders or other notices that we are legally required to send may be sent regardless of your optional email, receipt or notification preferences.


9. HOW TO CANCEL YOUR MEMBERSHIP

You can cancel your membership directly within the Wiggle app.

Go to:

My Profile → Manage Subscription

The Manage Subscription button is displayed at the top of the My Profile section.

From there, you can manage your subscription, including cancelling your membership or switching off automatic renewal where available.

You do not need to contact us before cancelling and there is no required notice period.

We will not require you to use an unnecessarily complicated process in order to cancel.

If you cancel outside an applicable refund or cooling-off period, your membership will ordinarily remain active until the end of the period you have already paid for and will then end without another renewal charge.

Where your membership has been purchased through a third-party app store or payment platform, you may also be required to manage your subscription through that platform.


10. MANAGING YOUR SUBSCRIPTION

Through the Manage Subscription section of the Wiggle app, where available, you may be able to:

  • view your current membership;

  • cancel your membership;

  • switch automatic renewal on or off;

  • manage your payment or billing preferences;

  • choose whether to receive optional billing notifications;

  • choose whether to receive email receipts;

  • upgrade to another membership tier; and

  • manage other subscription settings.

Certain transactional, safety, legal or subscription notices may still be sent to you even if you have disabled optional notifications.

In particular, disabling optional billing notifications does not prevent us from sending notices that we are legally required to provide, including applicable renewal and cooling-off notices.


11. UPGRADING YOUR MEMBERSHIP

You may be able to upgrade your membership to another Wiggle membership tier, including Bendy Buttery Club or one-to-one coaching, subject to availability.

Before confirming an upgrade, you will be shown the applicable price and billing arrangements.

Where an upgrade results in an immediate payment, credit, pro-rata adjustment or change to your billing date, this will be displayed as part of the upgrade process where applicable.

Different membership tiers may contain different features, levels of support, coaching access, availability and prices.

Upgrading does not remove any statutory consumer rights that apply to the new transaction.


12. PRICES AND PAYMENTS

The price of your membership will be clearly displayed before purchase.

Where required, prices displayed to consumers will include applicable taxes.

Payments may be processed by third-party payment providers.

By purchasing a membership, you authorise the applicable recurring charges associated with the membership you have selected.

If a payment fails, we may retry the payment and may temporarily restrict access to paid features while payment remains outstanding.

We will not intentionally charge you an amount that has not been disclosed or authorised in accordance with your membership.


13. CHANGES TO MEMBERSHIP PRICES

We may change membership prices from time to time.

A price change will not retrospectively change the amount you have already paid for an existing billing period.

Where a price change will affect a future renewal, we will provide reasonable advance notice where required and explain the new price and when it will apply.

You will have the opportunity to cancel or switch off auto-renewal before the new price applies.

Price changes will be implemented in accordance with applicable consumer law.


14. IMPORTANT FITNESS AND MEDICAL DISCLAIMER

Wiggle provides general fitness, exercise, strength, mobility and educational information.

Wiggle is not a medical service.

Nothing provided through Wiggle is intended to constitute medical advice, diagnosis, treatment, physiotherapy, rehabilitation or other healthcare advice.

Information, programmes, exercises, assessments, classes and recommendations provided through Wiggle should not be treated as a substitute for advice from a doctor, physiotherapist or other appropriately qualified healthcare professional.

Exercise may not be appropriate for everyone.

If you have concerns about your ability to exercise safely, you should seek appropriate professional advice before beginning or continuing an exercise programme.

This is particularly important if you:

  • have an existing injury or medical condition;

  • are experiencing unexplained or persistent pain;

  • have recently undergone surgery;

  • are pregnant or have recently given birth;

  • have been advised to restrict physical activity;

  • are taking medication that may affect your ability to exercise; or

  • otherwise have concerns about your health or ability to exercise safely.

You should never disregard professional medical advice because of something you have viewed, read or been told through Wiggle.


15. RISKS ASSOCIATED WITH EXERCISE

All physical exercise involves some degree of risk.

Potential risks include muscle soreness, fatigue, strains, sprains, aggravation of existing conditions, falls and other injuries. More serious health events can occur in rare circumstances.

You are responsible for exercising within your own abilities and limitations.

You should:

  • use appropriate equipment and surroundings;

  • ensure that you have sufficient space to exercise safely;

  • follow instructions carefully;

  • use modifications where appropriate;

  • avoid exercises that you reasonably believe are unsuitable for you; and

  • stop exercising if you experience concerning symptoms.

You should stop exercising and seek appropriate medical assistance if you experience symptoms such as severe or unusual pain, chest pain, fainting, severe dizziness, significant difficulty breathing or other symptoms that concern you.

No online fitness platform can observe or account for every aspect of an individual's physical condition.

Our exercise demonstrations, recommendations, modifications and programmes therefore provide general guidance and cannot guarantee that a particular exercise is appropriate for every individual.

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by our negligence.


16. PROGRAMME RECOMMENDATIONS

Wiggle may recommend or assign programmes based on information you provide, including your:

  • goals;

  • exercise experience or ability;

  • available equipment;

  • available time; and

  • other information requested during onboarding.

These recommendations are intended to help personalise your fitness experience.

They are not medical assessments or medical prescriptions.

Receiving a particular programme or exercise recommendation does not mean that Wiggle or AADAMRICHARDSON LTD has medically assessed you or certified that every exercise is safe or appropriate for you.

You are responsible for providing accurate information and exercising within your capabilities.


17. COACHING, ASSESSMENTS AND FEEDBACK

Certain membership tiers, including Bendy Buttery Club and one-to-one coaching, may include additional services such as mobility assessments, personalised programming, exercise reviews, technique feedback, coaching calls or direct communication.

Unless expressly stated otherwise, these services remain fitness and exercise coaching services and are not medical diagnosis, physiotherapy or healthcare.

Any assessment or feedback is based on the information and material available to the coach and should not be interpreted as medical clearance.

If we believe an issue may require assessment by an appropriately qualified healthcare professional, we may recommend that you seek professional medical or healthcare advice before continuing with particular exercises.


18. LIVE AND RECORDED CLASSES

Memberships may include access to live and/or recorded classes.

Class schedules, instructors, availability and content may change.

We may reasonably cancel, reschedule, replace or alter individual classes.

Where practical, we will provide notice of significant changes.

We do not guarantee that a particular class, instructor, timetable or recording will remain available indefinitely unless this has expressly formed part of your purchase.


19. SERVICE AVAILABILITY

We aim to provide a reliable Service, but we cannot guarantee that Wiggle will be uninterrupted or error-free at all times.

Temporary interruptions may occur because of:

  • maintenance;

  • software updates;

  • technical problems;

  • internet or hosting failures;

  • third-party services;

  • app-store issues;

  • security requirements; or

  • circumstances outside our reasonable control.

We may update, improve, replace or discontinue individual features where reasonably necessary.

Where a change materially reduces a paid Service you have purchased, we will act fairly and in accordance with applicable consumer law.


20. INTELLECTUAL PROPERTY

Unless otherwise stated, all content made available through Wiggle is owned by or licensed to AADAMRICHARDSON LTD.

This includes, without limitation:

  • videos;

  • exercise demonstrations;

  • programmes;

  • workouts;

  • class recordings;

  • educational materials;

  • graphics;

  • photographs;

  • text;

  • designs;

  • software;

  • branding; and

  • other original content.

Your membership provides you with a limited, personal, non-exclusive and non-transferable right to access this content for your own personal, non-commercial use.

You must not, without our permission:

  • copy or redistribute our content;

  • record or republish classes or videos;

  • sell or sublicense our programmes;

  • share paid content with non-members;

  • use Wiggle content to provide commercial fitness services to other people;

  • systematically download, scrape or extract our content;

  • remove copyright, trademark or ownership notices; or

  • otherwise commercially exploit our intellectual property.

Your access to paid content ordinarily ends when your entitlement to the applicable membership ends.


21. ACCEPTABLE USE AND COMMUNITY FEATURES

You must not use Wiggle:

  • unlawfully or fraudulently;

  • to harass, threaten or abuse another person;

  • to interfere with the security or operation of the Service;

  • to attempt unauthorised access to our systems or another user's account;

  • to upload malicious software or code;

  • to infringe another person's intellectual property or other rights; or

  • to systematically scrape or extract our content or data without permission.

If community features are available, you must behave respectfully towards other users and members of our team.

You must not post unlawful, threatening, abusive, discriminatory, defamatory, sexually explicit or otherwise seriously inappropriate content.


22. SUSPENSION OR TERMINATION OF ACCOUNTS

We may suspend or terminate an account where we reasonably believe there has been:

  • a serious or repeated breach of these Terms;

  • fraud or attempted fraud;

  • misuse of Wiggle;

  • unlawful activity;

  • abuse or harassment of users or members of our team;

  • unauthorised sharing or commercial use of our content; or

  • a genuine security risk.

Where appropriate, we will provide reasonable notice and an opportunity to resolve the issue.

Immediate action may be taken where reasonably necessary to protect our users, our business, our intellectual property or the security of the Service.

Your statutory consumer rights remain unaffected.


23. THIRD-PARTY SERVICES

Wiggle may integrate with third-party services, including:

  • payment processors;

  • app stores;

  • wearable devices;

  • health or activity platforms;

  • casting services; and

  • other technology providers.

Third-party services may be subject to their own terms and privacy policies.

We are not responsible for third-party products or services outside our reasonable control.

This does not affect any legal responsibility we have for providing the Wiggle Service in accordance with applicable consumer law.


24. PRIVACY AND PERSONAL INFORMATION

Your use of Wiggle is also subject to our separate Privacy Policy.

Our Privacy Policy explains how we collect, use, store and protect personal information and the rights available to you.

You should read the Privacy Policy alongside these Terms.

Where we process information relating to your health or other information subject to additional protection under data protection law, it will be handled in accordance with applicable legal requirements.


25. YOUR CONSUMER RIGHTS

If you are a UK consumer, you have legal rights in relation to services and digital content.

Nothing in these Terms excludes, restricts or replaces rights that cannot lawfully be excluded.

Applicable consumer law may, among other things, require digital content to be of satisfactory quality, fit for a particular purpose where applicable and as described, and services to be provided with reasonable care and skill.

Our 14-day money-back guarantee is provided in addition to your applicable statutory rights.


26. OUR RESPONSIBILITY TO YOU

We are responsible for loss or damage that is a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill.

We are not responsible for loss or damage that was not reasonably foreseeable when you entered into your agreement with us.

Wiggle memberships are supplied for personal and domestic use.

We are therefore not responsible for business losses arising from your use of a consumer membership, including loss of profit, revenue, business opportunities or business interruption.

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

In particular, nothing in these Terms excludes or limits our liability for:

  • death or personal injury caused by our negligence;

  • fraud or fraudulent misrepresentation; or

  • any other liability that cannot legally be excluded or limited.


27. CHANGES TO THESE TERMS

We may update these Terms where reasonably necessary, including because of:

  • changes to Wiggle;

  • new features or membership options;

  • changes to our business;

  • security requirements;

  • changes in law or regulation; or

  • changes to the technology or third-party services used to provide Wiggle.

Where a change materially affects your rights or obligations, we will provide reasonable notice where required.

We will not use this provision to make arbitrary changes that unfairly disadvantage you.

The latest version of these Terms will be made available through Wiggle and/or our website.


28. COMPLAINTS AND CONTACTING US

If you have a question, complaint or problem relating to your membership, payment, refund, cancellation or use of Wiggle, please contact us.

29. GOVERNING LAW

These Terms are governed by the laws of Scotland.

If you live in Scotland, the Scottish courts will have jurisdiction over disputes relating to these Terms.

If you live elsewhere in the United Kingdom, you retain any rights available to you under applicable consumer law to bring proceedings in the courts of the part of the United Kingdom in which you live.

If you are located outside the United Kingdom, you may also have mandatory consumer rights under the laws of the country in which you live which cannot legally be excluded by these Terms.


30. GENERAL

If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply.

If we delay enforcing any provision of these Terms, this does not mean we have waived our right to enforce it later.

These Terms, together with our Privacy Policy and any additional terms or information clearly presented to you when purchasing a particular membership or service, form the agreement between you and us regarding your use of Wiggle.

No person other than you and AADAMRICHARDSON LTD has any right to enforce these Terms except where applicable law provides otherwise.

Nothing in these Terms affects your statutory rights as a consumer.
